Terms & Conditions

1. INTERPRETATION & VARIATION
1.1 In these Terms and Conditions the following definitions apply: 
”Company” means LGF Fitness Pty Ltd, trading as LagreeFIT. 
”Client” means any person that attends a LagreeFIT Studio. “Studio” means studios at Level 1, 515 Military Road, Mosman, Sydney NSW 2088; Level 1, Suite 102 16-28 Foster Street, Surry Hills, Sydney NSW 2010. A reference to a Studio in the Terms and Conditions will be to the studio at which a Client has booked to attend sessions. 
“Terms and Conditions” means these terms and conditions.
1.2 References in the Terms and Conditions to the singular will include the plural and vice versa and references to the masculine gender will include references to the feminine gender.
1.3 The Terms and Conditions are accepted by attending a Studio.
1.4 The Company reserves the right to vary and revoke the Terms and Conditions from time to time which variation it may consider necessary or desirable for the regulation of the affairs of the Studio and the conduct of Clients. Any such changes will be notified to Clients and, until revoked, are and will be binding on Clients.

2. CLIENTS
2.1 Subject to these terms and conditions, when a person has booked a class or a private session, they become a Client of LagreeFIT.
2.2 Acceptance of a person as a Client is in the absolute discretion of the Company.
2.3 The Company reserves the right to expel from the Studio, suspend for a specific period or refuse to renew the membership of any Client whose conduct is or may, in the Company’s reasonable opinion, be injurious to the character of the Studio or which amounts to a breach of the Terms and Conditions or where such expulsion is otherwise in the interests of the other Client of the Studio. Any Client so expelled will forthwith cease to be a Client of the Studio and will not be entitled to any refund for any period during which their membership is suspended.
2.5 Clients must be 18 or over to attend a Studio. Client aged 14 -17 years, may attend with the Company’s prior permission, with a parent or guardian.

3. PAYMENT TERMS
3.1 Details of session prices and gift certificate prices are available at www.lagreefit.com.au.
3.2 A Client may not attend any session at the Studio without first booking and paying for the relevant session.
3.3 Payments in any amount are non-refundable.

4. BOOKINGS AND CANCELLATIONS
4.1 A Client may only book, cancel or reschedule sessions for themselves via their personal Studio account at www.lagreefit.com.au. We do not accept cancellations or reschedules via email or telephone.
4.2 Sessions are booked on a first-come first-served basis. A Client may use the waiting list facility at www.lagreefit.com.au. If a Client joins the waiting list for a particular session and obtains a confirmed spot in that session, their booking will be subject to the Terms and Conditions in the usual way.
4.3 Class packs are valid for 3 months from and including the date of purchase. No extensions to expiry date.
4.4 The LagreeFIT Membership is valid from date of purchase.
4.5 NO SHOW POLICY & FEES: If a Client books a class and subsequently does not attend, they have prevented another Client from attending. Clients on class packs will forfeit payment for the session. Clients on the LagreeFIT membership will be charged a $20 no show fee for failure to attend a booked class.
4.6 CANCELLATION POLICY & FEES: A strict 12-hour cancellation policy applies to all group class bookings. Class pack holders who “late cancel” (less than 12 hours prior) forfeit the payment for that session. LagreeFIT Membership holders who late cancel will be charged a $10 late cancellation fee per incident. No exceptions.  A 24-hour cancellation policy applies to all private sessions. Private sessions cancelled within 24 hours will forfeit payment for that session.

5. FITNESS & HEALTH
5.1 By agreeing to these Terms and Conditions, Clients hereby confirm that they have no health problems (including without limitation cardiac irregularities; spinal, bone, joint, tendon or ligament injuries; spells of dizziness; asthma (or other breathing difficulty); diabetes, epilepsy or any allergy which may affect their participation in any sessions at the Studio.
5.2 It is the Client’s sole responsibility to notify the Studio before attending any session of any circumstances affecting their health which may be exacerbated through use of the Studio and/or which may have arisen or worsened since their last session at the Studio (if any).
5.3 Clients are advised not to undertake strenuous physical activity without first seeking medical advice if they have concerns over their physical condition and wellbeing. Clients with low/high blood pressure and/or cardiac irregularities should not attend class. If there is any doubt, the Client should consult his doctor.
5.4 The Company reserves the right to refuse access to any Client if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of Studio facilities.
5.5 Clients are required to follow the instructions of the instructor at all times.

6. LIMITATION OF LIABILITY
6.1 The Company cannot be held responsible for any particular session, instructor and/or item of equipment not being available for whatever reason. The Company reserves the right to make alterations to the sessions, instructors and/or equipment, as well as to those ancillary facilities (e.g. showers), provided to Clients, without notice and in its absolute discretion and the Company will not be liable for any loss occasioned by such alterations except insofar as such loss is by law incapable of exclusion.
6.2 It is the Client’s responsibility to ensure that they are capable of undergoing a routine of exercises provided by any programme which they follow or class which they attend. Clients accept the risk of injury from performing exercises and using specialist equipment and are advised to consult their doctor prior to beginning any session. Advice provided by LagreeFIT instructors at no time constitutes medical advice.

7. DRESS
Clients should attend sessions barefoot or, if preferred, with grip socks.

8. SAFETY & HYGEINE
8.1 In the interests of safety and hygiene, no crockery, glass or food are permitted in the changing rooms or studio. Only water is permitted in the Studio. No pets are permitted in the Studio buildings or grounds.
8.2 Clients must not attend a Studio if they have any form of contagious disease or infection.
8.3 Clients must use the main entrance to the Studio when entering or leaving the Studio. Fire exits, which are clearly marked, are there in the interests of safety and Clients must not interfere with these exits for any reason. In the event of a fire, Clients should  make their way to the nearest available exit.
8.4 Smoking is forbidden in the Studio.

9. GENERAL
9.1 The Company may, if a Client opts in, communicate with the Client by electronic mail (“email”) and text message. By providing an email address to the Company the Client consents to receiving email communications from the Company, including notices pursuant to the Terms and Conditions. The Client also accepts the risk that email or text message may not be a secure and confidential means of communication. The Company will not be liable for any loss or damage suffered as a result of communicating with a Client by email or text message.
9.2 Clients are required to give written notice to the Company of any change of email address or phone number. Failing such notice, all communications will be assumed to have been received by the Client within five days.
9.3 The Company reserves the right to refuse admission to the Studio.
9.4 Client must at all times comply with any reasonable directions which the Company may issue to ensure the smooth operation of the Studio.
9.5 Any marketing, educational or other materials of any nature whatsoever produced by the Company in connection with the Studio and which are made available to Clients at the Studio will at all times remain the property of the Company and will be subject to the Company’s copyright.

9.6 The Client agrees that LagreeFIT is in no way responsible for the safekeeping of personal belongings. The Client acknowledges that classes may be physically strenuous and the Client voluntarily participates in them with full knowledge that there is risk of personal injury, property loss or death. The Client agrees that neither the Client, their heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against the Company, or its employees or its Clients,  for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.

By booking a class at LagreeFIT the Client automatically agrees to the above terms and conditions.
